Cyprus Probate (Re-Sealing) Law

The legal doctrine of “Lex rei sitae” provides that the law of the country where immovable property (house or land) is situated governs the transfer of title to property.With regards to immovable property registered in the name of diseased persons, irrespective of the country where the death has occurred, Cyprus law applies to such property.Cyprus law provides for the rights of persons to dispose of their properties after death and for the relevant procedures to be followed. Although it is recommended that owners’ of immoveable property in Cyprus execute a will in Cyprus, Cyprus law provides for specific cases where the Grant of Probate or Letters of Administration issued by a foreign competent court may be re-sealed in Cyprus and an administrator may be appointed by the court to administer their estate in Cyprus. In such cases the intended administrator should file an application at court which must be supported by:

  •  copies of the Grant of Probate and will, or the Grant of Letters of Administration,
  • which must be certified as true copies by the issuing court, and
  • a power of attorney of the executor/s or administrator/s appointed by the court.

Upon completion of the administration the administrator should file with the court:

  • final accounts of his administration,
  • a declaration by the foreign executor or administrator that the administration in Cyprus was carried out to their satisfaction.
